§1. GENERAL PROVISIONS
1. These Terms and Conditions define the rules for participation in open training sessions, closed training courses, as well as the complaint procedure.
2. The organizer of the Training Services is StatSoft Polska Sp. z o.o., Cystersów 9, 31-553 Kraków, District Court for the Kraków Śródmieście, XI Division of the National Court Register, KRS 0000174490, NIP: 667-10-19-064, REGON: 350859518, Share capital 100 000 PLN, hereinafter referred to as the “Organizer.”
3. Definitions:
- Organizer – StatSoft Polska Sp. z o.o.
- Participant – a person taking part in the training session
- Ordering Party – a person or entity registering a Participant for the Training Session, including the payer
- Registration Form – an on-line form or PDF document available on the Organizer’s website, completed by the Participant or the Ordering Party for the purpose of registering for a Training Session
- Training Session – an open training session organized online or onsite for various participants
- Closed Training Course – a training session based on a dedicated offer prepared by the Organizer and intended for a closed group of participants.
§2. REGISTRATION FOR TRAINING SESSIONS
1.Registration for a Training Session may be completed:
- on-line by completing the Registration Form and clicking the “Register” button
- by e-mail by sending a scanned copy of the completed and signed Registration Form
2. Submission of the completed Registration Form constitutes acceptance of these Terms and Conditions.
3. Registrations for Training Sessions shall be accepted in the order of receipt until all available places are filled.
4. Registration shall be completed no later than 2 business days before the start of the Training Session. In the case of registrations submitted after this deadline, the Participant shall contact the Organizer’s office by telephone.
5. Confirmation of acceptance for the Training Session shall be sent to the Participant electronically to the e-mail address provided in the Registration Form.
6. The Organizer reserves the right to change the date or cancel the Training Session if the minimum number of participants is not reached. Confirmation of the Training Session date will be provided no later than 7 days before the scheduled date.
7. A preliminary reservation of a place in a Training Session is possible. To make a reservation, the online form available on the Organizer’s website must be completed or the Organizer’s office must be contacted by telephone. A reservation is non-binding and does not require payment. It remains valid for 14 days, unless otherwise agreed with the Organizer. A reservation shall become a confirmed registration for participation in the Training Session upon receipt by the Organizer of the completed Registration Form before the reservation expiry date.
§3. CANCELLATION OF PARTICIPATION
1. Cancellation made at least 14 days prior to the commencement of the Training Session shall not result in any financial liability.
2. Cancellation made between 7 and 13 days prior to the commencement of the Training Session shall result in an obligation to pay 50% of the Training Session fee.
3. Cancellation made less than 7 days prior to the Training Session or failure to attend the Training Session shall result in an obligation to pay the full fee.
4. Notice of cancellation shall be submitted in writing by electronic means to: info@statsoft.pl or directly to the e-mail address of the course supervisor appointed by the Organizer.
5. Subject to prior notification and approval by the Organizer, it is possible to replace the registered Participant with another person.
§4. PAYMENT TERMS
1. Unless otherwise agreed by the Parties, the fee for participation in the Training Session shall be based on the price indicated on the Organizer’s website. All prices listed on the website are net prices.
2. Unless otherwise agreed by the Parties, the Ordering Party shall be obliged to pay 100% of the Training Session fee plus the applicable VAT by bank transfer to the Organizer’s bank account no later than 2 business days prior to the commencement of the Training Session.
3. Training Sessions are subject to taxation in accordance with the regulations in force on the date of invoice issuance (currently 23% or “VAT exempt” rate). An invoice with a “VAT exempt” rate may be issued upon submission by the Participant of an appropriate declaration confirming the right to VAT exemption.
§5. COMPLAINTS
1. Complaints shall be submitted in writing by e-mail to: info@statsoft.pl within 7 days from the date of completion of the Training Session.
2. A complaint shall include: the Participant’s first name and surname, e-mail address, the name and date of the Training Session, as well as the subject matter and justification of the complaint. Complaints that do not contain the above information shall not be considered.
3. Complaints shall be processed within 14 days from the date of receipt in correct and complete form.
4. A response shall be sent electronically to the e-mail address indicated in the complaint submission.
§6. GENERAL ORGANISATIONAL PROVISIONS
1. The Organizer reserves the right to change the trainer or the date of the Training Session in the event of serious unavailability of the trainer or force majeure, while maintaining the substantive level and scope of the training program. Participants shall be informed without undue delay of such circumstances via direct telephone or e-mail contact.
2. Participants shall receive a certificate of attendance. Receipt of the certificate is conditional upon attendance at the Training Session.
3. Participants shall receive training materials. No transfer of proprietary copyright in materials used during the Training Session, in particular training materials, presentations, etc., shall take place.
4. Recording of the Training Session (audio and/or video) and dissemination of its content is prohibited.
5. Training Sessions may be subject to class observation or trainer evaluation, to which the Participant hereby consents.
§7. CLOSED TRAINING COURSES
1. The terms and conditions for Closed Training Courses, including the date, location, program, payment terms, and complaint procedures, shall be individually agreed with the Ordering Party and set out in the Organizer’s offer or formal agreement.
2. In the absence of separate arrangements, the relevant provisions of these Terms and Conditions concerning Training Sessions shall apply accordingly.
3. A Closed Training Course is intended exclusively for the Ordering Party and the group of participants indicated by the Ordering Party, and participation of any third parties shall require the Organizer’s prior consent.
§8.PERSONAL DATA PROCESSING
1. Registration for participation in a Training Session constitutes consent by the Participant to the processing of personal data.
2. The administrator of personal data is StatSoft Polska Sp. z o.o., with its registered office in Kraków, address: Cystersów 9, 31-553 Kraków, e-mail: info@statsoft.pl. Any requests concerning personal data described in the Privacy Policy should be addressed to the e‑mail address provided above (or to the postal address indicated).
